The present work analyzes the use of Artificial Intelligence in the Brazilian Criminal Justice System, investigating to what extent its application can compromise legal certainty and the fundamental guaranties of the defendant. The research problem questions to what extent this technology affects essential principles of due process, considering the hypothesis that its implementation, without adequate control, can lead to biased decisions, technical errors, and violations of fundamental rights. The general objective is to understand the ethical and legal impacts resulting from the adoption of Artificial Intelligence in criminal proceedings, highlighting its risks, limits, and challenges. Methodologically, the research employs a qualitative and exploratory approach, based on bibliographic review, jurisprudential analysis, and the study of normative documents. The results indicate that, although Artificial Intelligence offers potential to enhance judicial efficiency, its application without clear guidelines and adequate oversight can threaten impartiality and the protection of human rights.
