CHALLENGES AND OPPORTUNITIES: THE DICHOTOMY BETWEEN RE-SOCIALIZATION AND PUBLIC SAFETY IN TEMPORARY RELEASES OF PRISONERS

Abstract

This paper conducts a critical review of the literature on the challenges and opportunities related to the dichotomy between reintegration and public safety in the context of temporary releases of prisoners, as outlined by Law No. 7.210/1984 (Penal Execution Law). The study examines the main themes discussed in recent literature, emphasizing the regionalization of granting policies and the effectiveness of temporary releases as a mechanism for reintegration. The paper is structured into sections that include an introduction, theoretical foundation, methodology, critical analysis, and final considerations. The theoretical foundation explores the relationship between reintegration and public safety, addressing the ethical and social implications without delving into specific risk assessment tools. The methodology details the qualitative approach and the criteria for selecting the reviewed papers. The critical analysis of the papers examines the impacts of temporary releases following the Anticrime Package, recidivism rates, and the application of these releases in different regional contexts. Overall, this paper reveals that, although temporary releases are a constitutional right, their implementation presents significant challenges, including the need for improvements in monitoring and reintegration policies.
