OBSTETRIC VIOLENCE AND CRIMINAL RESPONSIBILITY IN BRAZIL

Abstract

Obstetric violence emerges as a relevant topic in the Brazilian legal scenario, as it encompasses practices that violate women's fundamental and reproductive rights throughout the period of pregnancy, childbirth and postpartum, manifesting itself through abusive, disrespectful and negligent acts by part of health professionals. This analysis was based on a bibliographical survey, aiming to obtain primary sources to elucidate the primary characteristics of this phenomenon and aimed to discuss the issue of obstetric violence from a criminal aspect, in a national context. In this context, we sought to identify the patterns of how this phenomenon manifests itself, its consequences and the impact it has on women's lives. Obstetric violence emerges as an unavoidable challenge in the field of reproductive health in Brazil. The research in question shed light on the complexity underlying this issue, emphasizing the need for recognition and immediate action, as violent conduct not only transgresses women's rights, but can also have serious physical and psychological implications for pregnant women and women in labor.
