Abstract

This article will demonstrate the main points of convergence and divergence of the most diverse legal texts, also observing the social, moral and philosophical perspectives regarding the interruption of pregnancy. Therefore, throughout the text, the stigma that permeates the topic will be noticeable, causing the legislator, in the process of drafting laws, and the judiciary, in their application, to promote social inequality. Furthermore, this work will highlight the norms of civil law, citing as an example the rights inherent to the unborn child and highlighting the moment in which it becomes a subject of rights, criminal law currently addressing the permissive hypotheses and constitutional law in the face of the inherent collision of fundamental rights, citing the current discussion in the Federal Supreme Court regarding ADPF 442.
