CRIMINAL LAW AND THE PENSION LAW

Abstract

Each year, family courts imprison thousands of people for failure to pay child support. The vast majority of these parents do not receive protection from criminal proceedings because the courts characterize the routine execution of alimony as a "civil" issue. Recent studies have challenged this examined understanding of how criminal law and family law work together to police certain conduct. , and in which cases civil prison is required. We will differentiate between civil and criminal prison according to Brazilian jurisdiction. In the case of prison sentences, the main objective is punishment, removing the individual from society. However, the case of civil prison, the objective is not punishment, but to enforce an obligation, this distinction being made in this article will deal with civil imprisonment.
