Abstract

The object of study of this research project is the relationship between the traditional ecological knowledge of the Omágua/Kambeba people and the legal protection of the environment in the Brazilian legal system, with a territorial focus on the municipality of São Paulo de Olivença, located in the Alto Solimões region. The main objective of the research is to investigate the extent to which the Brazilian legal system recognizes and protects this traditional knowledge as instruments of environmental protection, seeking to identify existing gaps and challenges in implementing this normative recognition in the conservation of the Amazon. To achieve this purpose, the study will use a qualitative approach, consisting of an interdisciplinary bibliographical review and normative analysis, with an emphasis on the Federal Constitution of 1988 9BRASIL, 1988), Law No. 13,123/2015 (BRASIL, 2015), the Indian Statute, ILO Convention No. 169 9BRASIL, 1989) and PNGATI (BRASIL, 2015), additionally incorporating oral memory reports of the Kambeba people, through autoethnography, as an empirical source. As expected results, the project seeks to demonstrate that the ancestral management practices of these people constitute highly effective systems for conserving Amazonian ecosystems. It is expected to prove, therefore, the need for Brazilian Environmental Law to overcome exclusively Western paradigms, overcoming current limitations and gaps to fully internalize this traditional knowledge as autonomous and effective instruments for the protection of socio-biodiversity.
