THE CHALLENGES OF SHARED CUSTODY AS A MEASURE TO COMBAT PARENTAL ALIENATION

Abstract

This article sought to discover what are the challenges that open up the practice of acts of parental alienation that make it difficult to achieve the end of shared custody, because there has been a significant increase in divorce actions involving minor children and the State Public Prosecutor's Office from Paraná reported that cases of Parental Alienation are more frequent in litigious processes of marital dissolution, causing several negative impacts on the emotional, psychological and behavioral aspects of those involved. The research methodology was a bibliographic review based on the qualitative analysis of primary sources, such as: the law and jurisprudence of higher courts; as well as secondary sources, such as: scientific articles, course completion works and works by renowned scholars. In short, the research found that although the Law and Jurisprudence protect the relationship between parent and children, the lack of agreement between parents is the biggest challenge to shared custody in combating parental alienation.
