EXISTENTIAL DAMAGE DUE TO MEDICAL DIAGNOSTIC ERROR

Abstract

The scope of the present study is to expose the analysis of the existential damage related to the mistake in the medical diagnosis. To approach this phenomenon, a qualitative methodology was used using the bibliographic research technique. Initially, the conceptual delimitation of medical civil liability, medical error and damage resulting from an error in the medical diagnosis was carried out. Subsequently, jurisprudential precedents from Brazilian judicial bodies relevant to the matter were exposed. Additionally, a survey of publications was carried out, using sources such as Scientific Electronic Library Online (SCIELO), CAPES Periodicals and Google Scholar.
