This article examined the role of the family caregiver and the vulnerability to which they are exposed, with the primary objective of analyzing potential protective measures for this group. To this end, the study employed bibliographic and documentary research, alongside an examination of current regulations and pending legislative bills. The analysis revealed that the caregiving relationship significantly impacts the family caregiver's life, often placing them in a position of vulnerability and economic dependence on the person receiving care. A legal gap was also identified, as there are no specific protective measures tailored to this group. In light of this issue, the study analyzed legal mechanisms applicable to the caregiver within both the social security and social assistance frameworks. It concluded that both spheres offer measures capable of providing some degree of protection, although legislative action is required to align existing benefits with the realities of the caregiver's situation. Finally, the study inferred that the social assistance framework is a more viable avenue than the social security system for achieving the desired solution, particularly due to the scope of protection it offers.
