THE ADVERSE POSSESSION AS AN INSTRUMENT OF LAND REGULARIZATION IN IRREGULAR SUBDIVISION

This article addresses the feasibility of using adverse possession as an instrument for land regularization of irregular subdivisions through an analysis of the principle of the social function of property. The purpose of this research is to discuss important concepts for understanding the subject, such as the adverse possession institute, addressing its concept, characteristics, requirements, modalities, as well as the exploration of Law No. 6766/79, which provides for the subdivision of urban land, in order to finally verify whether it is feasible to use usucaption to regularize irregular allotment of light. For that, a bibliographical research was developed with a deductive approach, using the analysis of scientific articles, doctrines and jurisprudential understandings.
