RESERVATION OF PLACES IN PUBLIC COMPETITIONS FOR PEOPLE WITH DISABILITIES: ANALYSIS ON (EX) INCLUSION

The present work analyzes whether the reservation of vacancies in public tenders for people with disabilities, through its various models, generates inclusion or still maintains the historical exclusion of people with disabilities. Therefore, the work brings the concept of public policies, affirmative actions and people with disabilities. Subsequently, it explores the Principle of Equality, the Principle of the Dignity of the Human Person and the Principle of Merit. It also addresses statistics of the general population regarding the number of employed and unemployed people, comparing them with statistics of people with disabilities regarding the number of employed and unemployed people, statistics of the general population regarding the income from their work, comparing them with statistics of people with disabilities regarding income from their work, statistics from the general population regarding the presence of durable goods in their residence and access to the internet comparing them with statistics of people with disabilities regarding the presence of durable goods in their residence and access to Internet. It also explores the constitutional and infraconstitutional laws that relate to the subject. Finally, it concludes that people with disabilities would have very disproportionate chances of joining the public service if not supported by legislation.
