Abstract

This article presents the following question: what are the effects of excluding spouses from inheritance rights in contemporary times? The general objective of the research seeks to identify the advantages and disadvantages of a possible reform in the civil code, describing the implementation of reform in family and inheritance law, aiming to understand the exclusion of spouses from inheritance, as well as the way in which the population participates in decisions and changes in society. The nature of the research is qualitative, descriptive, its means are bibliographical and documentary, and the data collection instrument is document analysis. The results indicate that such reform enables efficient succession planning; however, the majority of the population still does not have the understanding and incentive for this post mortem organization of the renewals brought by Bill 4/2025, which deals with the reform of the Civil Code.
