Abstract

the transmission of digital assets by reason of death has emerged as a relevant topic in inheritance law due to the increasing digitalization of society and the lack of specific regulations in brazil. This paper analyzes the transmission of these assets by reason of death, addressing their definition, characteristics, challenges and legal controversies. The research, of an exploratory and interpretative nature, uses a qualitative methodology based on a bibliographic and documentary review. The study investigates the gap in brazilian legislation and the often contradictory case law, which oscillates between the protection of the deceased's privacy and the inheritance rights of the heirs. The study concludes that specific legislation is needed in brazil, which balances the interests of the heirs with the privacy of the deceased.
