Abstract

As a consequence of human actions and the alteration of the balanced environment, a series of climatic effects are felt by the population, environmental tragedies previously little seen in Brazil. Much of these changes result from the intervention of human beings in search of development, not always in line with environmental standards. It turns out that those responsible for this damage are hardly affected by its effects, since, residing in privileged and remote locations, they live in greater comfort while the local population is hit more severely. As a rule, it is peripheral people, black people, indigenous people and marginalized populations who suffer the most environmental impacts. Therefore, this study analyzes the causes and impacts of environmental racism in Brazil and its effects on environmental justice, using bibliography, with data, concepts and opinions available in doctrines, online legal magazines and other places for expert debate. The result of the literature review is the writing of this scientific article that expresses the existence of environmental racism in Brazil, with emphasis on its causes and impacts, with ways to indicate the possibility of civil liability or other means of sanction, according to with national legislation and jurisprudence.
