THE (IN)CONSTITUTIONALITY OF THE VIRTUAL JURY

The present work proposes an approach, initially, generic about the Jury Court and its nuances, followed by a more specific approach about the recommendation nº 62/2020 of the National Council of Justice (CNJ), in promoting the due adaptations to the changes caused by the new coronavirus (COVID-19), in the sessions of the online jury court. The objective of the work consists of a constitutional analysis of the proposal for virtualization of the special jury procedure. For this, this research will use bibliographic data, jurisprudence and reports. As a hypothesis, the present monograph presents, if the online session of the jury would face the fundamental principles and guarantees listed by the Federal Constitution of 1988, it would imply the inapplicability of the legal provisions regarding the secrecy of voting, the incommunicability of the jurors and orality.
