Abstract

The Brazilian prison system faces longstanding structural challenges that compromise the effective protection of the fundamental rights of individuals deprived of liberty. This reality becomes even more evident in municipalities in the interior of the State of Amazonas, where the lack of adequate prison facilities, prison overcrowding, and the use of police stations as permanent detention sites reveal a scenario of institutional precariousness and state omission. In this context, the present study aims to analyze the structural and administrative deficiencies of the prison system in the interior of Amazonas, highlighting how such shortcomings contribute to the violation of fundamental rights and to the worsening of detention conditions, especially for vulnerable groups. The theoretical framework is based on the contributions of Michel Foucault, Drauzio Varella, and Cezar Roberto Bitencourt, whose works allow for an understanding of the prison system from historical, empirical, and criminal law perspectives. The methodology adopted consists of qualitative research, with an exploratory and descriptive approach, using bibliographic review and documentary analysis of legislation, institutional reports, and official data related to the penitentiary system. The expected results indicate that the structural precariousness of prison facilities in the interior, combined with the lack of effective public policies, contributes to the maintenance of a punitive system incapable of ensuring minimum conditions of dignity for individuals deprived of liberty. It is concluded that the prison reality in the interior of Amazonas reveals an urgent need to reformulate penitentiary policies in order to ensure respect for human rights and the rehabilitative purpose of punishment.
