Abstract

How do impunity and the normalization of violence against women affect the effectiveness of legal protection and fundamental rights? This study aims to analyze impunity and the normalization of gender-based violence in contemporary society, in light of the constitutional principle of human dignity. It discusses how state omission, the insufficiency of public policies, and the persistence of gender stereotypes contribute to the trivialization of violent practices and the perpetuation of inequalities between men and women. It is observed that, although the Brazilian legal system provides important protective instruments, such as the 1988 Federal Constitution, Law No. 11,340/2006 (Maria da Penha Law), and Law No. 13,104/2015 (Feminicide Law), their effectiveness remains limited by cultural, structural, and institutional factors that foster impunity. In this context, based on a qualitative approach and bibliographic method grounded in legal doctrines, legislation, and international human rights treaties, the study proposes that addressing gender-based violence must go beyond the normative sphere, requiring social and cultural transformations that ensure the full protection of women and the realization of human dignity as an essential value of the Democratic Rule of Law.
