Abstract

Parents' difficulty in separating the roles of spouse and parent can lead to children being used as a means of retaliation against the other parent. Through false accusations and maneuvers that make it difficult for children to relate to one of their parents, the alienating parent disrespects the duties inherent in parenthood, causing serious moral damage and compromising the fundamental rights of children and adolescents. The aim of this dissertation was to investigate the impacts of parental alienation on family dynamics, with an emphasis on the need for a flexible legal approach that is adaptable to contemporary social realities within the scope of Family Law. The method used was qualitative research, with predominantly theoretical and empirical technical procedures. On the theoretical side, relevant legal doctrines and legislation were analyzed. On the empirical side, judicial decisions were analyzed, seeking to understand how the legal system has dealt with this complex issue.In conclusion, parental alienation is a serious and complex problem that requires an integrated and attentive approach. Although Brazilian legislation offers a solid basis for protecting children's rights, its effective application depends on close collaboration between all those involved, including the judicial system, mental health professionals and families. It is suggested that future studies explore in depth the effectiveness of public policies and family mediation strategies to mitigate the impacts and consequences of parental alienation. In addition, it is recommended to investigate how different cultural and socioeconomic contexts influence its occurrence and consequences, contributing to the formulation of more inclusive and effective approaches.
