USE OF BLOCKCHAIN TECHNOLOGY AS AN INSTRUMENT FOR CONSOLIDATING DEMOCRACY AND ITS EVENTUAL COMPATIBILITY WITH THE BRAZILIAN ELECTORAL SYSTEM

Abstract

This study is carried out in the research field of Theory of Democracy and the Democratic State of Law in Brazil and aims to analyze the innovations arising from blockchain technology, as well as its possible application as a mechanism for consolidating Brazilian democracy based on the legal system national legal. The following specific objectives were defined: a) conceptualize democracy and identify its forms; b) explain and address the innovations arising from blockchain technology, as well as the possibility of incidence of said technology as a democratic mechanism in the exercise of suffrage and c) analyze possible compatibility of the application of Blockchain technology with the Brazilian electoral process. The question is: how can Blockchain technology be used in the realization of Brazilian democracy? A qualitative approach methodology is used, having been developed through bibliographical, data and legal research. Analyzing the results obtained, it is verified that, although there is no specific normative provision regarding the use of the blockchain network as an instrument for exercising suffrage, there is no obstacle to its use, as long as the network is configured in accordance with the Brazilian electoral process. Thus, its use can serve as an instrument for the consolidation of Brazilian democracy, since it allows the participation of the citizen in the decision-making process inherent to the State, either through direct manifestation about a certain theme or through the election of its representative, in both cases the guarantees and fundamental rights inherent to the exercise of suffrage will be guaranteed through the implementation of a blockchain specifically created for this purpose.
