Abstract

 The main question of this scientific article is the fact that “like the current Brazilian prison system, can penitentiaries be effective in the resocialization of the individual who is serving his sentence?”. It is known that the Brazilian prison system is considered one of the fields inserted in society, where it is possible to verify that public security has a direct relationship with this institute and is going through delicate situations. It is notorious that a large part of individuals who commit criminal offenses are repeat offenders, thus, making living in fear of the action of criminals become routine, not only in large urban centers, but also in small towns and rural areas. Given this scenario, it is important to carry out a more in-depth study about the reasons that involve the commission of crimes and the effectiveness of the Brazilian prison system in the face of the resocialization of the individual. Therefore, this article will bring the nuances, opinions, jurisprudence, legal norms and foundations that can delimit and explain the determining factors of the effectiveness of the Brazilian prison system and its influence in the field of public security.
