THE CRIMINAL RESPONSIBILITY OF THE LEGAL ENTITY

Abstract

This research aims to analyze the criminal liability of the legal entity in the Brazilian legal system. Although it is expressly provided for constitutionally, it suffers a lot of criticism. To this end, a brief analysis of the institute of the legal entity and the distinction of existing theories will be made. After, the criminal liability of the legal entity will be examined in the light of the Federal Constitution of 1988, The Environmental Crimes Act (Law 9.605 of 1988), as well as the theoretical model adopted. Finally, an analysis of the criminal liability of the legal entity in Brazil and the implementation of compliance to inhibit anti-legal acts involving legal entities will be made.
