Abstract

This study analyzes the application of Law No. 15.123/2025 in addressing domestic violence, its advances, challenges, and the role of artificial intelligence within this context. The research starts from Law No. 15.123/2025, which establishes security, accountability, and oversight parameters for the use of AI, imposing technical and legal challenges on institutions. At the same time, the legal framework can strengthen public policies to combat domestic violence, provided that AI solutions are implemented in accordance with the constitutional principles of human dignity, gender equality, and comprehensive protection. Thus, the aforementioned law regulates and enhances the use of artificial intelligence systems in combating domestic violence, allowing the identification of advances, challenges, and concrete impacts on the protection of victims. The deductive method is adopted, with a qualitative approach, based on bibliographic and documentary research, institutional reports, and public data. The results demonstrate that Law No. Law 15.123/2025 contributes to improving the state's response to domestic violence, especially by typifying the increase in penalty for the crime of psychological violence when committed with AI (deepfakes), in conjunction with the LGPD (Brazilian General Data Protection Law), the Marco Civil da Internet (Brazilian Internet Bill of Rights), and the jurisprudence of the STF (Supreme Federal Court) (Themes 533/987) on platform liability. It is concluded that artificial intelligence, when regulated ethically, represents a significant advance in the prevention, identification, and monitoring of cases, although it requires integration with the Maria da Penha Law and rigorous oversight.
