Abstract

Burnout Syndrome has become one of the main occupational diseases of our time, especially due to transformations in labor relations, the intensification of productivity, and the constant psychological pressures present in the work environment. Characterized by physical and emotional exhaustion resulting from chronic work-related stress, the syndrome has received greater attention from the legal system and health institutions, particularly after its recognition by the World Health Organization as a phenomenon associated with the occupational context. In this context, the present study aimed to analyze Burnout Syndrome from the perspective of Labor Law, with emphasis on employer responsibility and the challenges related to proving causality. The methodology used consisted of qualitative research, of an exploratory and descriptive nature, developed through bibliographic and documentary review, with analysis of doctrines, scientific articles, legislation, jurisprudence, and regulations related to worker health and safety. The results demonstrated that the legal characterization of Burnout Syndrome still faces practical difficulties, mainly regarding proving the link between mental illness and working conditions, which directly impacts the recognition of the employer's civil liability. It was also found that excessively competitive work environments, exhausting work schedules, and the absence of prevention policies contribute significantly to the mental illness of workers. It was concluded that the prevention of Burnout Syndrome requires joint action between employers, the State, and society, and the adoption of effective measures to protect mental health in the workplace is indispensable.
