HISTORICAL AND CONCEPTUAL ASPECTS OF THE INSTITUTE OF REFUGE

The issue of asylum has been gaining increasing interest from society due to the conflicts existing in the world today, such as the Syrian War, the Ukrainian War, among others, which have generated refugee crises in various regions of the planet. This issue is still shrouded in much ignorance regarding its concept on the part of the population, being confused with other types of migration. Given this context, the objective of this study is to discuss the historical and conceptual aspects of the institution of refuge. The methodology used was a bibliographic review of articles, doctrines, and master's theses that deal with refugees and topics related to refuge. An exploratory, descriptive, and qualitative research approach was used. It is concluded that a refugee is a person who suffers persecution because of religion, race, nationality, political issues, and membership in a social group. The issue of refuge dates back thousands of years in human history, with the creation of the institution of refuge in the mid-1920s, gaining importance, especially in the context of World War II. Finally, it can be seen that the issue of migration today is complex, with other groups of individuals in the migratory context, in addition to refugees and asylum seekers, such as economic migrants, stateless persons, internally displaced persons, environmental migrants, and victims of human trafficking, all of whom also need protection.
