THE CLASSIFICATION OF PSYCHOLOGICAL VIOLENCE IN THE PENAL CODE BY LAW 14.188/2021: ADVANCES AND CHALLENGES IN THE PROTECTION OF WOMEN

For decades, psychological violence remained relegated to a secondary level, either due to difficulties in proving it or the absence of specific classification in the penal legal system. This normative gap largely resulted in the perpetuation of impunity and the lack of protection for countless women who suffered from daily abusive conduct, such as humiliation, blackmail, threats, social isolation, and emotional manipulation. The enactment of Law No. 14,188, of July 28, 2021, represented a milestone in confronting violence against women by including the classification of psychological violence as a crime in Article 147-B of the Penal Code. Given this reality, this project aims to analyze the classification of psychological violence against women in the Brazilian Penal Code, introduced by Law No. 14,188/2021, highlighting its advances and challenges for the effective protection of women's dignity. It is based on a literature review, using scientific articles, books, periodicals, and current legislation on the subject. Data collection will be carried out using databases such as SciELO, Google Scholar, among others, from 2020 to 2025. The results aim to identify the main difficulties in the practical application of the law, including evidentiary and institutional aspects.
