Abstract

This paper aims to analyze succession planning from the perspective of the ITCMD (Tax on Inheritance and Donation Transfers), presenting legal strategies to minimize the tax burden in the transfer of assets and rights. The ITCMD is a state tax levied on the transfer of assets through donation or inheritance, regulated by specific state laws that establish its rates and procedures. Succession planning emerges as a legal and financial strategy to organize patrimonial transfer, seeking to reduce costs, conflicts, and tax impacts. The study also discusses recent legislative changes that made the ITCMD progressive and expanded its tax base, highlighting the importance of efficient succession planning.
