THE ABSENCE OF REGULATION OF ARTIFICIAL INTELLIGENCE IN THE BRAZILIAN LEGAL SYSTEM AND ITS IMPACTS ON HUMAN RIGHTS

Artificial Intelligence (AI) stands as one of the most remarkable achievements of human creativity, yet it also raises some of the most profound ethical and legal dilemmas of our time. As AI becomes increasingly embedded in daily life, society is challenged to reconcile technological innovation with the preservation of human dignity and fundamental rights. This paper reflects on how the absence of specific regulation in Brazil’s legal system may weaken essential guarantees such as privacy, equality, and personal autonomy. Grounded in a deductive and bibliographic approach, the research examines the evolution of AI, its ethical risks, and the shortcomings of current national laws, particularly the Internet Civil Framework and the General Data Protection Law. The findings reveal that technological progress, while beneficial, must rest on solid ethical and legal foundations to ensure that humans remain at the center of innovation. Thus, the study emphasizes the urgent need for a regulatory framework that promotes a responsible, transparent, and human-centered use of artificial intelligence—so that progress serves justice, freedom, and human dignity, rather than undermining them.
