Abstract

This article discusses the causes, impacts, and possible alternatives for balancing the right to health with the efficiency of the public health system, which trigger the judicialization of health in Brazil, reflecting citizens' pursuit of access to treatments and medications through the Judiciary. This phenomenon stems from flaws in public health management, lack of access to medical technologies, and inefficiencies in the distribution of essential medicines. While court decisions can guarantee individual rights, they also pose challenges to the financial sustainability of the Unified Health System (SUS).
