This article sought to present a discourse on inclusion and attention to the diversity of students with Special Educational Needs (SEN) in the classroom, whether associated with a disability or not. These represent a constant challenge in the educational field, raising many questions, such as the main challenges schools and educators face in inclusion and attention to diversity, such as stigmatization and discrimination in the school environment. Inclusion can be interpreted as a complex social phenomenon, resulting from actions carried out by numerous institutions, including the government, educator training institutions, schools, people with disabilities, and their families. The effectiveness of rights and laws aimed at inclusion means, on the one hand, that rights serve as guidelines for state action and, on the other, that they serve as indicators for the application of other laws in the legal field—in other words, the possibility of interpreting the law in light of these foundations.
