DEMOCRATIC SCHOOL MANAGEMENT AND THE RIGHT TO EDUCATION

This study focuses on democratic governance as an essential principle for realizing the right to education in Brazil. The central objective is to discuss the role of democratic school governance in realizing the right to education, contributing to the contemporary debate on public education policies. The research used a literature review method, with a qualitative and descriptive approach, based on works, dissertations, articles, and legal provisions, such as the 1988 Federal Constitution and the Law of Guidelines and Bases of Education (Law No. 9,394/1996). The results showed that, although Brazilian legislation ensures democratic governance as a principle of public education, its implementation still faces obstacles such as administrative centralization, the fragility of school boards, and limited resources. It was evident that democratizing governance requires institutional autonomy, strengthening school councils, encouraging community participation, and valuing education professionals. It is concluded that democratic management must be understood as a social and political practice aimed at building a participatory school, essential to guarantee the right to education with equity and quality.
