THE ROLE OF THE CNJ IN COMBATING PREDATORY LITIGATION

This article analyzes the role of the National Council of Justice (CNJ) in combating predatory litigation in Brazil, a phenomenon characterized by the mass filing of artificially created lawsuits to obtain undue advantages, which causes enormous harm to the Judiciary and society. The research demonstrates that the CNJ has been acting on multiple fronts, adopting measures to address this challenge, notably through the issuance of CNJ Recommendation No. 159/2024, which establishes unified guidelines for identifying, addressing, and preventing abusive litigation. The study also highlights the creation of a platform for integrating information databases among courts, as well as concrete measures adopted to curb procedural manipulation and protect vulnerable citizens. It is concluded that the coordinated action of the CNJ has been fundamental to preserving Judicial efficiency, procedural economy, and access to Justice itself, reaffirming its constitutional role as an inducer of effective judicial policies.
