APPLICATION OF ARTIFICIAL INTELLIGENCE IN THE UNIFORMIZATION OF JURISPRUDENCE IN CIVIL PROCEDURE

This article investigates the application of artificial intelligence (AI) as a tool to support the standardization of case law in Brazilian civil procedure. Initially, the precedent system in the national legal system is analyzed, highlighting its normative foundations, such as articles 926 and 927 of the Code of Civil Procedure (Law No. 13,105/2015), and essential concepts such as ratio decidendi, summaries, binding precedents, distinguishing, and overruling. The importance of standardizing judicial decisions and the obstacles faced by the Judiciary in this regard are also discussed. Next, the historical and conceptual evolution of AI, its gradual incorporation into the Judiciary, and the limits of its performance are addressed, highlighting the need for human supervision and the non-replacement of judges by machines. In this context, initiatives such as Resolution No. 615/2025 of the National Council of Justice (CNJ) and initiatives already used today, such as the “Victor” system in the Federal Supreme Court, are analyzed. Finally, the study explores how AI has been used to assist in the analysis and standardization of judicial decisions, the benefits and ethical challenges involved, such as algorithmic biases and advances in so-called explainable artificial intelligence (xAI). The research concludes that, although it does not replace human action, AI represents a promising instrument to promote greater jurisprudential coherence, as long as it is used responsibly, transparently and with institutional control.
