THE IMPACTS OF THE ANTI-CRIME PACKAGE (n°13.964/2019) ON THE BRAZILIAN PENITENTIARY SYSTEM

Over The Years, severas pratiques by the Judiciary have become evident and have been questioned in the legal community. Factors involving the legality of such acts have brought to light several legal taboos and resulted in a political and social movement that aimed to bring more transparency and regulation to the work of judges in Brazil. To this end, Law No. 13,964/2019, called the Anti-Crime Package, was approved and duly sanctioned by the Brazilian National Congress. It regulates such work and sets limits to the Judiciary, as well as guaranteeing the fundamental rights of prisoners, developing methods for investigating and elucidating crimes, and altering the maximum sentence to be applied. Law No. 13,964/2019 has undergone some more stringent changes in recent years. One of the main changes occurred when innovations were inserted into the Brazilian Code of Criminal Procedure and Penal Code. In addition, the Anti-Crime Law also brought other new features, such as increasing the maximum prison sentence from 30 to 40 years, and expanding the list of crimes that are considered heinous. In addition, other types of crimes were also included, such as genocide, theft with the use of explosives and robbery with restriction of the victim's freedom. The limitation of hypotheses for progression of regime and conditional release were also sanctioned as a way of toughening the Law.
