LEGAL RECOGNITION OF STABLE UNIONS IN POLY-AFFECTIVE RELATIONSHIPS

Abstract

This paper aims to examine polyamorous unions from the perspective of fundamental rights and constitutional law, investigating their compatibility with principles that make up the Brazilian legal system. To this end, it used an inductive method, which allowed demonstrating the recognition of polyamorous stable unions in the legal system, in addition to bibliographical research and indirect research (doctrine and jurisprudence). Initially, it will address the evolution of the concept of family in the constitutions, then the conceptualization of polyamorousness, with the evolution of stable unions and their concept. Finally, principles and jurisprudence are presented in order to reflect on a possible recognition of stable unions in polyamorous relationships.
