AVOENGA ADOPTION AND THE PRESERVATION OF THE FAMILY BOND: THE BEST INTEREST OF THE CHILD AND ADOLESCENT IN THE BIOLOGICAL FAMILY

With the new concepts of family formation, the 1988 federal constitution allows grandparent adoption to be carried out, aiming to guarantee the permanence of the child or adolescent in their family environment of origin, aiming at the best interest of the child or adolescent. However, the Statute of the Child or Adolescent (ECA) prohibits such a process from being carried out, thus prohibiting the legal act. However, case law and doctrines reinforce the permission, ensuring the fundamental rights of the child or adolescent. Thus, the work aims to guarantee the analysis of grandparent adoption, showing that such an act is better for both parties, and guaranteeing the permanence of the bond and preservation of family ties.
