This study examines gender quota fraud in the context of Brazil's proportional elections, with an emphasis on the case of Federal Representative Maurício Marcon (Podemos/RS), whose mandate was annulled by the Regional Electoral Court of Rio Grande do Sul. The research reflects on the foundations and effects of the proportional representative system, the role of the Electoral Mandate Challenge Action (AIME), and the implications of gender quota fraud on the electoral system and party dynamics. Structured into three sections, the paper discusses the contextualization of the proportional electoral system, the gender quota institute and its fraud typified as an electoral offense, and a critical analysis of the case in question. Using a bibliographical methodology, grounded in legislation, jurisprudence, and doctrine, the study contextualizes the regulatory framework and critiques the effectiveness of the legal imposition of gender quotas, pointing out the risks of practical distortions and fraud. The study concludes with the need to revise the current model, proposing more effective approaches to promote female representation in Brazil's political landscape.
