Abstract

Teleworking develops with the advancement of technology, and telematic means are fundamental to this new type of work. This approach proposes improvements for both employees and employers, also benefiting the economy and the environment. Although the concept had already been considered in Brazil in the 90s, its regulation happened late, only in 2017, during the Labor Reform. Its popularization intensified due to the COVID-19 pandemic, when social isolation became a public health priority. Thus, the subject gained prominence in the discussions, raising issues that were not specifically addressed by the legislator in the five articles that deal with teleworking. This resulted in an increase in legal demands and greater difficulty in reaching uniform decisions.
