This paper analyzes working hours control as a fundamental strategy to prevent occupational burnout and ensure workers' rights. The main focus is to identify solutions that protect employees, especially in small businesses where the lack of control can lead to physical and mental strain. The research is justified by the urgent need to address non-compliance with working hours, the social impact of excessive hours, and the protection of workers' rights. The research method that will be used is the deductive method, made viable through exploratory, bibliographic, and documentary research. Regarding data analysis, both qualitative and quantitative techniques will be used to improve the analysis of the results found throughout the research.The overall objective is to verify the existence of working hours control mechanisms in companies, while specific objectives include presenting the constitutional and legal limits of working hours, discussing the role of the State and unions, and exploring the challenges faced in proving overtime. The findings indicate that despite regulations, practice encounters significant challenges, requiring stricter oversight. The conclusion emphasizes that working hours control is essential to ensure decent working conditions and prevent occupational burnout.
