THE LEGALIZATION OF WEAPONS AS AN INSTRUMENT OF SELF-DEFENSE

This scientific article has as its theme: The legalization of carrying weapons as an instrument of self-defense. This work seeks to analyze and understand the benefits arising from the relaxation of the carrying and possession of firearms in Brazilian society, highlighting its consequences. The central problem of this article is related to the ineffectiveness of the State in guaranteeing, in practice, fundamental rights, such as life, liberty, security and private property. The main question of this research is: How would the legalization of carrying weapons positively influence society? Based on the previous question, the general objective of this work is to analyze how owning and carrying a weapon can assist in self-defense and potentially reduce crime. The specific objectives of this article are to present the positive effects caused by the legalization of the carrying of firearms in Brazil, as well as to contextualize the structural problems and the importance of implementing self-defense in practice in order to guarantee fundamental constitutional rights, verify that criminals will always find an illegal means of obtaining a firearm, leaving society in a situation of extreme vulnerability, and understand the difference between possession and carrying of a firearm. To prepare this article, the method used was bibliographical research through articles, theses, doctrines, websites, monographs, as well as legislation and jurisprudence. The research methodology used a qualitative approach, focusing on theoretical analysis and the interpretation of contextual phenomena. Thus, the expected results of this article are to demonstrate that the legalization of the carrying of firearms can contribute positively to society, as long as there is specific and adequate training, thus ensuring in practice the fundamental rights and guarantees provided for in article 5 of the Federal Constitution.
