THE CONFIGURING OF BIDDING CRIMES ACCORDING TO LAW 14,333/2021

Since this is public money that aims to ensure the well-being of the entire community, spending on works and acquisitions is subject to compliance with the rules set forth in the Law on Public Tenders and Contracts. For decades, the bidding process was regulated by Law 8,666/1993. However, in April 2021, the new Law on Public Tenders and Contracts was enacted: Law 14,133/2021. With the entry into force of the new law, several provisions on the bidding procedure were changed, including the criminal provisions that changed the classification of illicit conduct practiced in the Bidding processes. Given the entry into force of Law No. 14,133/2021 and the legal changes regarding the bidding processes to be followed by the Public Administration, the research aims to solve the problem of what are the main legal changes regarding the conduct of the agent and the configuration of crime in the bidding processes for the contracting/sale of products and services. Written according to the deductive method, it is part of a bibliographic review, with material selected according to the qualitative research method, with results presented in textual form, more precisely through citations of laws, doctrines and jurisprudence that will make a comparison between bidding crimes in the old and new Bidding Laws.
