ACCESS TO JUSTICE AS A FUNDAMENTAL RIGHT OF WOMEN IN SITUATIONS OF DOMESTIC VIOLENCE

The objective of this article is to question whether public policies aimed at combating violence against women are available to all women in situations of violence. It will also be discussed whether these policies are guaranteeing access to justice for this population. Initially, the phenomenon of domestic violence against women and how it originated through the culture of patriarchy will be discussed in general terms. Next, the main public policies for combating violence against women and their role in accessing justice for women in situations of violence will be described, in addition to verifying their availability in the territory of the state of Pernambuco. Access to justice as a fundamental right will also be addressed, mentioning international standards, the concept and provision of this right in the Brazilian Constitution. Finally, with the demonstration of increasing numbers of violence in the state of Pernambuco, question the availability of public policies in light of CEDAW Recommendation No. 33.
