The issue of the (im)possibility of civil arrest of grandparents due to non-compliance with the legal duty to provide food is the subject of intense academic and legal debate. This Work will address the controversy surrounding this issue and the importance of discussing the fine line between liability in external cases and the violation of grandparents' rights. The different theoretical and legal perspectives on the subject will be explored, analyzing arguments for and against the application of this measure. Furthermore, we will address relevant jurisprudential cases and relevant legislation in different countries, analyzing the historical and legal evolution of this issue. Legislative arguments will be examined, aiming to understand the foundations that support both the defense and criticism of this measure. The objective of this study is to offer a comprehensive understanding of the topic, providing insights for future research and discussions in the field of family law, thus generating a better judicial interpretation of the topic.
