ANALYSIS OF THE STATE’S OBLIGATION IN FAVOR OF ENVIRONMENTAL TRANSPARENCY

The article presents this question based on the constitutional principle of the right to environmental information, which is enshrined in the field of human rights as a political and civil right, essential to guaranteeing the fundamental right to a healthy and balanced environment. However, especially in the context of the risk society, the mere declaration of these rights is not enough to guarantee their effectiveness. In this sense, this work presents an analysis of Brazilian legislation relating to the topic, with the aim of understanding whether the national regulations guarantee theeffectiveness of the right of access to environmental information, or whether it does so in a strictly formal manner.
