This article deals with the right to special and inclusive education, an approach that seeks an educational system that guarantees learning conditions for all people with disabilities, without any form of segregation. The objective is to trace the historical-legislative evolution of this approach, indicating the basic concepts and pointing out the normative milestones that advanced the matter until the establishment of a new paradigm of education. Through a historical and mainly qualitative approach, bibliographical research was carried out, through books and articles, in order to shed light on the challenges faced by people with disabilities in the search for recognition of the right to education under equal conditions, within an idea of positive equality, both in public and private educational institutions.
