Social assistance is a fundamental right enshrined in the Federal Constitution of 1988. The Benefit of Continuous Provision created by Law n. 8,742 of September 7, 1993, and its subsequent amendments that regulated Article 203, V of the Federal Constitution of 1988 is an effective part of this right. The objective of this article is to evaluate the effectiveness of the right to social assistance based on the Benefit of Continuous Provision, which safeguards the dignity of the human person, offering an existential minimum to the disabled person and the elderly in social vulnerability, as well as its applications cool.
