Abstract

The present work addresses the theme related to moral harassment in the workplace, being conceded that the existence of this act is illicit precisely because of the social repercussion it produces and the constant extension of the damage to mental issues that person who is a victim of harassment. However, even if there are such basic premises, there is no such effective legislation on the subject, although there are policies to raise awareness about the healthy work environment, including involving interpersonal relationships in the workplace. Thus, the research in comment is justified by being the local work environment of great time lapse of experience notably should be a minimally harmonious place, time lapse of experience, without celeumas of psychological nature by the labor development. To this end, the problem of the study hovers in how the configuration of moral harassment in labor relations occurs, as well as its consequences to the development of the life of the harassed employee. Thus, in a more general way, the scientific article in question aims to highlight the constitutional importance of safeguarding the dignity of the human person in labor relations with a view to facing moral harassment in the workplace. In a more specialized way, the work seeks to demonstrate the existence, recognition and applicability of moral harassment in labor relations, as well as to specify the right to a healthy work environment and to describe the behaviors that fall under moral harassment. In a methodological way, the present study develops a bibliographic review, using books, jurisprudence and other scientific works specialized in the theme addressed. For a better structuring of the discussion that is proposed of the theme, the chapters were arranged as follows, the first will analyze the legislative characterization and practice of moral harassment in Brazil, later the challenges of the effective recognition of moral harassment, more precisely as to the civil responsibility of the employer, to thus discuss the pathological extensions arising from moral harassment in the workplace.
