CRIMINAL RECURRENCE: THE NEGATIVE REFLECTION TO INDIVIDUALS THAT COMMIT A NEW CRIME

Abstract

Recidivism is a topic of great relevance. In the doctrine, recidivism derives from “recidere”, which means to relapse, to repeat the act. In common terms, it is repeating the commission of the crime. For Damásio de Jesus, recidivism presupposes a final conviction for committing a crime. There is a recidivism only when the new crime is committed after the conviction of which there is no further appeal. Recidivism is a harmful institute for the agent who practices an act typified as a crime and such damages will be addressed in this article.
