Abstract

Cultural sociology, as an innovative theoretical approach, proposes an autonomous understanding of culture, moving away from perspectives that subordinate it to structural determinations. This article examines the contributions of this approach to the analysis of Law, highlighting concepts such as civil sphere, cultural trauma, and legal performances. Based on the "strong program" of cultural sociology (Alexander; Smith, 2010), it demonstrates that Law functions not only as a normative system but also as a symbolic field, where narratives and rituals shape collective meanings. Cases such as the recognition of LGBTQIAPN+ rights and the Maria da Penha Law are analyzed, illustrating how legal processes mobilize moral codes and historical traumas. The conclusion underscores that the effectiveness of Law depends on its ability to engage with cultural structures, reinforcing its legitimacy and social transformation.
