Abstract

This paper aims to conduct a theoretical review on digital inclusion and access to justice, considering that according to data from the latest census carried out by the Brazilian Institute of Geography and Statistics, around 20 (twenty) million people do not have access to the internet in Brazil. The review involved the analysis of 20 (twenty) articles from a closed platform, Revista dos Tribunais, and two open platforms, Google Scholar and JSTOR, published between 2020 (two thousand and twenty) and 2026 (two thousand and twenty six). Of the 20 (twenty) articles, 18 (eighteen) were in the area of law, 1 (one) in the area of education and 1 (one) in the area of global governance. The works analyzed allow for an updated view on the subject in the sense that, at the present time, digital inclusion is seen as a fundamental right for most authors. It was observed that digital exclusion affects the most socially vulnerable. Regarding the research question, it is clear that, at present, it is not yet possible to implement the principle of access to justice, in the broadest possible way, considering the considerable number of digitally excluded people in Brazil. There is a need for more in-depth studies on the close relationship between digital inclusion, access to justice and the principle of human dignity as essential for the full exercise of citizenship. The issue of access to justice will only be resolved by addressing the problem of digital inclusion.
