Abstract

This article addresses the Continuous Benefit Payment (BPC), provided for in the Organic Law of Social Assistance (LOAS), as an important instrument for guaranteeing a minimum income to elderly people and people with disabilities in situations of socioeconomic vulnerability. The study aims to analyze the main challenges to implementing the BPC, considering legal, administrative, and social aspects that impact access to the benefit. Although it has a welfare nature and is constitutionally guaranteed, its implementation faces several challenges due to the requirements for becoming a beneficiary, the complexity of administrative processes, the lack of access to information by beneficiaries, and the insufficiency of integrated public policies. Therefore, through a bibliographic and descriptive study, the study will analyze the main obstacles to granting the BPC, in light of current legislation, case law, and the role of social assistance agencies, proposing ways to overcome these obstacles and effectively guarantee the right to social assistance.
